1. Acceptance of Terms

By creating an account or using Waiver World, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our service.

2. Description of Service

Waiver World provides a digital platform for creating, distributing, and managing liability waivers and consent forms. Our service includes:

  • Digital waiver form creation and customization
  • Electronic signature collection
  • Secure storage of signed documents
  • Customer/signer management
  • Reporting and analytics

3. Account Registration

Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use Waiver World. By registering, you represent that you meet these requirements.

Account Responsibilities

You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Subscription and Billing

Free Trial

New accounts may be eligible for a free trial period. Trial features and duration are subject to change.

Paid Plans

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fees.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes

We may change our prices with 30 days' notice. Continued use after price changes constitutes acceptance.

5. Acceptable Use

You agree NOT to use Waiver World to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Create fraudulent or misleading waivers
  • Collect information about others without consent
  • Use the service for spam or unsolicited communications

6. Your Content

Ownership

You retain ownership of all content you create, including waiver templates, branding, and collected data. Waiver World does not claim ownership of your content.

License

By using our service, you grant Waiver World a limited license to store, process, and display your content as necessary to provide the service.

Responsibility

You are solely responsible for the content of your waivers and ensuring they comply with applicable laws. Waiver World does not provide legal advice and is not responsible for the legal validity or enforceability of your waivers.

7. Intellectual Property

The Waiver World service, including its design, features, and content (excluding your content), is owned by Waiver World and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8. Electronic Signatures

By using Waiver World's electronic signature service, you agree to conduct business transactions through the use of electronic signatures in place of physical signatures. You are not required to use electronic signatures in your business transactions.

You understand that electronic signatures are void where prohibited by law. Certain types of agreements governed by statutes and regulations may be excepted from electronic signature laws, including wills, certain real estate documents, and others. Waiver World does not determine, and shall not be responsible for determining, whether any electronic contract is subject to such exceptions or can be validly signed electronically.

When a document is electronically signed through Waiver World, we preserve an audit trail including: the signer's IP address, timestamp of signature, unique document identification, and signer name.

9. No Legal Advice

THE INFORMATION PROVIDED BY WAIVER WORLD IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED TO BE, NOR SHOULD IT BE INTERPRETED AS, LEGAL ADVICE. IF YOU REQUIRE LEGAL ADVICE, CONSULT AN ATTORNEY LICENSED TO PRACTICE IN YOUR JURISDICTION.

Waiver World provides templates and tools to create liability waivers, but we make no representations regarding the legal validity, enforceability, or sufficiency of any waiver created using our service. The effectiveness of liability waivers varies by jurisdiction and circumstance. Your use of Waiver World does not create an attorney-client relationship.

10. Disclaimer of Warranties

WAIVER WORLD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAIVER WORLD AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Waiver World and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your content, or your violation of these terms.

13. Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees
  • Create risk or legal exposure for Waiver World

You may delete your account at any time through the app settings. Upon termination, your right to use the service ends immediately, and we may delete your data in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

16. Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting us at legal@waiverworld.com. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Waiver World regarding the use of our service.

19. Copyright and DMCA

Waiver World respects the intellectual property rights of others. If you believe that any content on our service infringes your copyright, please notify us with the following information:

  • A description of the copyrighted work you claim has been infringed
  • A description of where the allegedly infringing material is located on our service
  • Your contact information (address, phone number, email)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature
